Malaysia's Seizure of Pakistan International Airlines Plane: A Shocking Turn of Events

Pakistan, currently grappling with a severe financial crisis, found itself in an embarrassing predicament when one of its national carrier’s planes was seized in Malaysia due to non-payment.

In January 2021, Pakistan’s national carrier operated a routine flight, PK 894, from Islamabad International Airport to Kuala Lumpur International Airport, just over two years ago. Unfortunately, when all the passengers had already boarded, the aircraft of Pakistan’s national carrier could not fly back home as Malaysian authorities seized it at the Kuala Lumpur International Airport. At that time it is to be confirmed from the authorities that the court of Malyasia has been given the order for the seizure. Dublin-based aircraft lessor, Peregrine Aviation Charlie Limited, faced non-payment of aircraft lease dues by international airlines.

Currently Pakistan is suffering from economic crises that resulted into cash crunch in the country. The country has already curtailed down the other administration expenses also.

Pakistan has failed to payment of lease of aircraft taken from Peregrine Aviation Charlie Limited due to cash crunch.

Peregrine Aviation Charlie Limited is a company based in Dublin, Ireland, that specializes in aircraft leasing. They provide airplanes on lease to various airlines and other organizations in the aviation industry. As an aircraft lessor, Peregrine Aviation Charlie Limited owns a fleet of planes and enters into leasing agreements with airlines, allowing them to use the aircraft for a specified period of time in exchange for lease payments.

Company alleged that Pakistan had stopped payment in July 2020 also. Company had filed case against the Pakistan International Airlines in London High Court in October due to failure of payment. The lease payment was around $14 million which had been pending for 6 months.

In response Pakistan International Airlines had replied at that time the situation of pandemic in the country adversely affected the aviation industry therefore payment of lease should had been reduced by the company.

Peregrine Aviation Charlie Limited closely monitored the operations of the flag carrier, without reaching any friendly resolutions or receiving payments.

When Peregrine Aviation Charlie Limited discovered that PK 895 was scheduled to land in Malaysia, the aircraft lessor took the step of appealing to the Malaysian court to seize the aircraft in accordance with international civil aviation leasing laws at that time.

The impoundment of the aircraft lasted for a period of two weeks, but it was finally released by the Kuala Lumpur High Court after both parties announced that they had reached a mutually agreeable settlement.

In a remarkable coincidence, AP-BMH, operating as flight PK 894, also faced detention by Malaysian authorities upon landing in Kuala Lumpur for the exact same reason currently. The approximate amount of payment of unpaid lease now is $4 million rupees.
